An appeal against unacceptable planning conditions restricting Permitted Development on a residential development in Luton have been allowed in full.

Blakeney Developments Ltd were aggrieved by the imposition of planning conditions restricting future Permitted Development in their new residential development site.

The planning appeal has been allowed in full and two conditions have been deleted as failing the tests of being necessary and reasonable.

The planning authority failed to demonstrate any exceptional circumstances to justify an exception from national policy.

The owners of the new properties will now be able to erect extensions or place buildings within the curtilage of their homes and insert roof windows in accordance with The Town and Country Planning (General Permitted Development) (England) Order 2015 (as amended).
